Terms of use

This user agreement (hereinafter referred to as the User Agreement) agreement, Agreement governs the relationship between HighChange and clients of the HighChange website (hereinafter referred to as the User).

Using the HighChange website (hereinafter referred to as the Site, Service) without registration user account (hereinafter - Account, Account) or with registering an account to use the HighChange service, The user agrees that he has read, understood and accepted all terms contained in this Agreement, as well as in the Policy privacy and FAQ (frequently asked questions, FAQs and other titles sections) of the service.

In addition to the terms of this agreement, the User is obliged to familiarize himself with a statement confirming the legality of the origin of funds and/or cryptocurrency assets.

If the User does not agree with the terms of the User agreement, use of the HighChange website is not permitted.

  1. Eligibility

    1. The User hereby agrees and confirms that he:

      • has reached the legal age required for adoption these terms and conditions;

      • the user was not suspended or prohibited from using Service earlier.

    2. If the User uses the Service on behalf of a legal entity, The User also represents and warrants that the legal entity duly registered and operates in accordance with applicable laws of the jurisdiction of its registration, and this the legal entity has authorized the User to act on its behalf.

  2. Terms and Definitions

    1. HighChange

      HighChange is a trademark of a system that provides Users with the opportunity to exchange digital and electronic currencies, as well as other digital assets.

    2. Service

      Service - a system for providing Internet services for the exchange, sale, and purchase of digital and/or electronic currencies, as well as other digital assets.

    3. User

      User is any individual using the services of the HighChange service.

    4. Digital Currency

      Digital currency - Bitcoin, Ethereum, Binance Coin, Binance USD, Tether USD, and any other cryptocurrencies and tokens based on blockchain.

    5. Electronic Currency

      Electronic currency - funds in the accounts of users of electronic payment systems.

    6. Payment System

      Payment system is a software and hardware product developed by a third party and representing a mechanism for implementing accounting of monetary obligations, as well as organizing mutual settlements between their users.

    7. Service Services

      Service services - providing assistance in conducting p2p operations between individuals for the purchase, sale, and exchange of digital currencies, as well as other services, information about which is posted on the HighChange website.

    8. Payment

      Payment - transfer of digital currency or fiat funds from User to User or Service, as well as vice versa.

    9. Order

      Order - an expression of the User’s intention to use one of the services offered by the Service by filling out an electronic form through the Website of the Service, on the terms described in the Agreement and specified in the parameters of this order.

    10. Partner

      Partner is a person who provides the Service with services to attract Users, as well as any other services.

    11. Card Verification

      Card verification is checking the ownership of the card (or account) to its owner. Conditions and availability of the affiliation check are set by the Service and can be done at a time for each new account (card) of the User.

    12. Rate

      Rate - the cost ratio of two digital currencies when they are exchanged.

    13. Messages

      “Messages” includes email messages.

  3. terms for Using an Account on the HighChange Website

    1. Exclusive Private Use

      The HighChange website is intended for private use only. By registering, the User consents to providing accurate data in accordance with the site's registration process. The User also agrees not to use any account other than their own and will not attempt unauthorized access to other users' accounts. Each User may only have one account on HighChange.

    2. Additional Verification

      The service may conduct additional checks and request necessary documentation (passport, card photo, video verification, proof of funds, etc.) to verify User-provided information. If the required documents are not submitted, the service reserves the right to refuse services and process a refund within 5 banking days, deducting internal and additional service fees.

    3. Transaction Blocking

      HighChange may block User operations to prevent fraud or activities that could cause financial or reputational harm to either the User or the Service. Transactions may be held for investigation and verification with payment gateways or issuing banks.

    4. Account Registration and Transaction Restrictions

      The HighChange administration reserves the right to deny, limit, or suspend account registration and transactions at any time and at its sole discretion until user-provided information is reviewed.

    5. Account Confidentiality

      The User is responsible for maintaining strict confidentiality of account information, including passwords and digital currency holdings. Any compromise of registration details may lead to unauthorized access and potential financial losses, including funds linked to bank accounts or credit cards.

    6. Security Alerts

      Users must update their email and phone number to receive security notifications from the service. The service is not liable for losses due to compromised login credentials unless caused by service negligence. The service does not guarantee notifications or specific actions regarding security breaches.

    7. Unauthorized Account Use

      Users must immediately notify the service via the provided email in case of unauthorized account use, suspected hacking, or security violations.

    8. Third-Party Responsibility

      User accounts are for personal use only. The User bears full responsibility for any actions or omissions of third parties who access or use their account.

    9. Payment Source Guarantee

      The User guarantees that payments will not be made from third-party addresses, cards, or accounts. Additionally, the User confirms that they are the sole recipient of funds and have full access to the accounts used in transactions. HighChange is not liable for losses if the User does not have access to these accounts.

    10. Prohibited Activities

      The User agrees not to use the Service for any criminal activities, including but not limited to purchasing prohibited substances, money laundering, illegal gambling, or terrorist financing. The User must comply strictly with the AML policy of the Service.

    11. Location Reporting and Suspicious Activity

      The User agrees not to use methods to hide their location and must provide accurate location data upon request. If the Service detects suspicious activity or prohibited actions, it may suspend the User Account, block transactions, and reject future transactions. Blocked transactions will be refunded minus service fees for processing and refunds, as outlined on the website.

  4. Services Provided on the HighChange Website

    1. Free Registration and Commission Fees

      The service is provided to the User free of charge to register an account. However, the Service may charge a commission for provided services. The specific commission amount is displayed to the User when creating an order. The commission amount is determined by the Site Administration unilaterally and may change. Ordering services on HighChange is carried out by sending the relevant order through the website with the domain name HighChange.

    2. Ownership of Digital Assets

      By using the Services, the User confirms that they legally own and dispose of fiat funds, electronic and/or digital currency, as well as any other digital assets involved in the relevant payment.

    3. Types of Services Provided

      HighChange provides the following types of services:

      • Service for the User to sell electronic and/or digital or fiat currency in real time to another User.
      • Service for the User to buy electronic and/or digital or fiat currency in real time from another User.

    4. User Instructions for Orders

      By filling out an order, the User instructs the Service to perform actions for the sale and transfer of digital and/or electronic or fiat currency to another User, on behalf of the User and at their expense.

    5. Service Remuneration

      The amount of the Service's remuneration for these actions is reflected in the order and confirmed by the User on one of the user interface pages.

    6. Transfer Obligations

      The Service is obliged to organize the transfer of the received digital or fiat currency to the details specified by the User, within the time allotted by the regulations. This is subject to force majeure events.

    7. Order Cancellation

      The Service has the right to cancel an order for purchasing digital and/or fiat currency if payment is not received within the time allotted for rate fixing.

    8. Completion of Transfer

      The obligation to transfer the received digital and/or fiat currency is considered fulfilled when the currency is debited from the corresponding payment system account of another User or service, as recorded in the transaction history.

    9. Purchase Organization

      By filling out an order, the User instructs the Service to organize the purchase of digital and/or fiat currency from another User and to assist in transferring cash equivalents to the User in the amount specified.

    10. Service Timing for Transfer

      The Service is obliged to transfer the monetary equivalent of the listed digital and/or fiat currency or digital assets to the User within the time specified, using the method chosen by the User.

    11. Service Remuneration for Purchases

      The Service's remuneration for these actions is reflected in the order and automatically confirmed by the User on one of the user interface pages.

    12. Transfer Completion

      The obligation of the Service is considered fulfilled when the corresponding amount is debited from the User's account.

    13. Disclaimer of Warranties

      All services are provided without any express or implied warranties. The Service does not guarantee 100% availability of the site or services and is not liable for delays, errors, or information loss.

    14. Site Maintenance

      HighChange may suspend the use of the site for maintenance purposes but will make reasonable efforts to notify Users in advance. Users assume the risks related to potential site unavailability or delays.

    15. Order Closing and Rate Adjustment

      The rate is fixed when the order is created. If payment is not received within the specified time, the order is closed. The User may request a refund if unsatisfied with the current rate.

    16. Order Cancellation and Refund

      If the User wishes to refuse the exchange within 24 hours of order creation, a refund will be processed minus 10% of the payment amount, provided the User has not yet received digital or fiat currency.

    17. Refund in Case of Unfulfilled Orders

      If the order is not fulfilled within the regulatory period, the User can demand a refund. The refund will be made in the same or more favorable digital asset at the time of return.

    18. Incorrect Network Payments

      If the payment for the order is made on the wrong blockchain or network, the Service may refuse to complete the order. A refund will be made within 10 days minus 10% of the order amount if possible.

    19. Wrong Asset Payments

      If the User pays with the wrong digital asset, the Service has the right to refuse to fulfill the order and return the payment. A refund will be processed within 10 days minus 10% of the amount.

    20. Blacklisted Card and Account

      If the User’s card or account is blacklisted, HighChange reserves the right not to return the funds.

    21. Payment Method Requirements

      Orders must be paid through the payment form on the website. Unauthorized payments may lead to order cancellation.

    22. Compliance with Legal Requirements

      The provision of services is subject to the legal requirements in the jurisdiction where the Service is legally registered.

    23. Transfer Time for Cards

      Credit to Visa and MasterCard cards can range from a few seconds to 5 working days. 99% of transfers are credited instantly.

  5. Cost of Services

    1. Tariffs Determination

      Tariffs are determined by the Service management and published on the Service website. The Service management has the right to change the Service tariffs without additional notice.

  6. Taxation

    1. Responsibility for Tax Payments

      The Service is not a tax agent for the User and will not notify the User regarding their tax obligations. The User undertakes to independently pay all taxes required in accordance with the tax laws of their jurisdiction.

    2. Reimbursement for Tax Payments

      In case the Service is required by authorities to pay taxes on behalf of the User or to cover any debt arising from the User’s failure to pay taxes, the User agrees to reimburse the Service for all such payments.

  7. Warranties and Responsibilities of the Parties

    1. Responsibility of the Service

      The HighChange service is financially responsible to the user in the amount of electronic and/or digital, fiat currency or digital asset that was transferred to the Service HighChange to execute the order in accordance with this Agreement.

    2. Service Scope

      The HighChange service provides services for organizing exchange, purchase, and sale of electronic and/or digital, fiat currency or digital asset. HighChange does not provide services for fundraising, does not provide payment for goods or services of other suppliers.

    3. Financial Losses from Illegal Actions

      HighChange service is not responsible for the user for financial losses caused by illegal actions of third parties that cannot be predicted or prevented.

    4. Force Majeure Events

      HighChange service is not responsible for financial losses caused by the inability to fulfill obligations due to force majeure circumstances such as war, floods, fires, earthquakes, and other natural disasters, strikes, changes in current legislation, or any other circumstances that the Service cannot influence or foresee.

    5. Payment System Errors

      HighChange service is not responsible for delayed or unrealized Orders caused by errors in the payment system or bank specified by the user. The User agrees that claims will be directed to the payment system or bank, and HighChange will provide necessary assistance to the best of its ability.

    6. Communication and Order Execution

      If communication flows are tampered with or negatively affect the normal operation of the Service's program code, order execution is suspended. Based on received funds, order parameters are recalculated or returned to the payer's details if the User disagrees with the recalculation.

    7. Non-Compliance Due to Force Majeure

      HighChange service is not responsible for non-compliance with these Terms of Use if caused by force majeure circumstances that could not have been reasonably prevented.

    8. Violation of Terms

      Failure to fulfill obligations or violation of these Terms will be considered in accordance with the laws of the country in which the Service is registered.

    9. User Responsibility

      The user is responsible for the accuracy and completeness of the information provided during account registration. If incorrect personal or order data is provided, HighChange is not liable for any resulting losses.

    10. Declaration of Truthful Information

      By agreeing to these Terms, the User confirms they have provided correct and truthful information and that they are not involved in illegal activities such as money laundering, terrorism, or trade in prohibited countries.

    11. Interference with Service

      The User agrees not to disrupt the operation of the HighChange Service by interfering with its software or hardware or distorting the parameters passed to the Service.

    12. Non-Advisory Role of HighChange

      The User acknowledges that HighChange does not act as a financial advisor and does not provide investment advisory services. Any relationship between the User and HighChange is not considered as advice.

    13. Force Majeure and User Responsibility

      The User is not responsible for failure to comply with these Terms if caused by force majeure, unforeseen events, or other factors that could not be reasonably prevented.

    14. Failure to Fulfill Obligations

      Failure to fulfill obligations arising from these Terms or violation of conditions will be considered in accordance with the laws of the country where the User is located.

    15. Monitoring Discrepancy

      If the User notices discrepancies with broadcasted rates, they must notify technical support, and they may be rewarded with a loyalty program level increase.

    16. Fraudulent Activity and Account Blocking

      If the User exploits a technical failure on the HighChange exchange, leading to financial or reputational losses, these actions will be regarded as fraud. The User's account will be blocked, and unfulfilled liabilities may be withheld as compensation for service losses.

  8. Applicable law and jurisdiction

    1. This agreement, as well as all disputes related to it, subject to consideration in accordance with the legislation of the country, in which the service is registered.

  9. Other Conditions

    1. Fraudulent and Illegal Transactions

      The use of the HighChange Service for fraudulent and illegal transactions is prohibited.

    2. Legal Obligation to Provide Information

      HighChange is legally obligated to provide information about payments, users, and transactions to any government agencies that have the legal right to request relevant information.

    3. Protection of User Information

      The protection of user information and other confidential data is provided in accordance with current legislation on the storage of personal data, in accordance with the jurisdiction of the user.

    4. Privacy Policy

      The method of processing and protecting personal information is described in detail in the Privacy Policy published on the HighChange Service website, which is required to enter into contractual relations between the user and the HighChange Service.

    5. Suspension of Operations in Case of Suspicious Activity

      The HighChange service, in case of suspicious activity during the registration of an order by the user, has the right to suspend the execution of such operations until the reasons for these actions are clarified to avoid damage from hacker attacks.

    6. Refusal to Execute Transactions

      The HighChange service has the right to refuse to organize the execution of transactions related to the exchange, purchase, or sale of electronic and/or digital, fiat currency, or digital assets if the transfer of such assets to the service account was made without completing an order using custom interfaces on the Service website. Assets transferred to the corresponding accounts (addresses, wallets, details) of the Service by the user without registration of orders may be returned to the user upon request, subject to a service commission deduction.

    7. Right to Refuse Service

      The Service Administration has the right to refuse to provide services to any user without explanation.

    8. Storage of User Information

      Information about the user and their operations is stored on the server and cannot be deleted. Upon the user's request, access to the account may be limited or removed.

    9. Response Time to User Requests

      The response time of the HighChange Service to user requests may be up to five working days from the date of receipt of the relevant user’s request.

  10. Force majeure

    1. If, in the event of force majeure, the User or HighChange is delayed or unable to complete any of these Terms, then such delay or failure to comply shall not will be considered a violation of these Terms, and neither the User nor Service HighChange cannot claim any loss or damage, arising from such circumstances.
  11. Final Provisions

    1. Agreement to Terms

      The terms and conditions are agreed upon with the User in electronic form during registration or when submitting an order for exchange, buying, or selling. Agreement to the Terms published in electronic form is valid and identical to written consent.

    2. Right to Modify Agreement

      The HighChange service has the right to unilaterally make changes to the Agreement by publishing changes on the Service Website. Changes come into force from the moment of publication, unless otherwise stated. The entry into force of the changes is not further determined when they are published. The user has the right to terminate the contractual relationship with Service HighChange due to its opposition to changes to such Terms. The user must notify the HighChange Service of his disagreement with changes to the Terms and termination of contractual relations by sending a corresponding letter to the service email.

    3. Email Communication

      The HighChange service has the right to send the User to the specified e-mail information about the status of the exchange process, as well as other information, including advertising. Unsubscribe from advertising mailings can be done by clicking on the appropriate button in the received letter.

    4. Intellectual Property

      Information posted on the site, including all graphics, images, text information, program codes, etc., is the property of HighChange and is protected by copyright laws.

    5. User Confirmation

      The user confirms that he is familiar with all provisions of these Terms and fully accepts them.

      The user can engage in a dialogue with HighChange employees during working hours via the online chat in the customer support section of the website HighChange. Additionally, users can send an email to the service mail for further inquiries.
